These terms have not been reviewed by a lawyer, particularly the liability, warranty and termination sections. They accurately reflect how NextCarHub operates as of the date above.
These Terms govern access to and use of NextCarHub (the "Service"), operated from Serbia by the operator of nextcarhub.com ("we", "us"). By creating an account you agree to these Terms on your own behalf and, if applicable, on behalf of the shop you represent ("you").
1. What the Service is
NextCarHub is appointment scheduling and customer management software for auto repair shops. It is not an accounting system, an invoicing system, or a parts management system, and it is not intended to be your shop's sole financial system of record.
2. Accounts
You are responsible for keeping your login credentials safe and for all activity under your account. Tell us promptly at hello@nextcarhub.com if you suspect unauthorised access. The person who creates the shop is its owner and controls billing and team membership.
3. Acceptable use
You agree not to: attempt to access another shop's data; upload malicious files; use the Service to store information you have no right to store; resell access to the Service; or use it in any way that breaks applicable law.
4. Your responsibilities
You are responsible for the accuracy of what you enter, and for having a proper basis to store your customers' personal details in a third-party system. Where your customers' data is concerned, you are the data controller and we are a processor — see the Privacy Policy.
5. Fees
The Service is billed per shop at $49 USD per month as a recurring subscription, taken through PayPal (by PayPal balance or by debit/credit card). New shops get a 14-day free trial from account creation; no payment details are required to start it.
If a payment fails, or no subscription is started before the trial ends, the ability to create and edit appointments is suspended until payment is resolved — your existing data is not deleted. You can cancel at any time through PayPal; cancelling stops future charges and access continues until the end of the period already paid for. We do not refund partial billing periods. We will email account holders before any price change affecting an existing subscription takes effect.
6. Data ownership
You own the data you enter. On cancellation it remains available for 30 days so you can reactivate without loss, after which it is deleted. During that window, or any time while your account is active, you can request an export by emailing us.
7. Availability
We aim for high availability but do not currently offer a formal uptime service-level agreement. Planned maintenance is rare and we try to keep it outside working hours.
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability arising out of these Terms or the Service will not exceed the amount you paid us in the twelve months before the claim.
9. Suspension and termination
You may stop using the Service and cancel at any time. We may suspend or terminate an account that breaches these Terms, or where required by law, and will give notice where we reasonably can.
10. Changes to these Terms
We may update these Terms. If a change is material we will update the date above and notify account holders by email. Continuing to use the Service after a change takes effect means you accept it.
11. Governing law
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict of law rules. Nothing here removes consumer protections that apply to you and cannot be waived under the law of your own country.
